Acceptable Use Policy
1. Purpose
This Acceptable Use Policy ("AUP") describes what you may not do with the Xaller.ai service, which is operated by XALLER AI, a trade name of ZPEACHY LLC ("Xaller.ai", "we", "us"). It is part of the Terms of Service and applies to every account and everyone who uses it. Xaller.ai answers calls to legitimate businesses; these rules protect your callers, other customers, our providers and the phone network.
2. Unlawful, harmful and deceptive use
You must not use the Service to:
- break any law or regulation, or help someone else do so;
- record, monitor or intercept calls without giving the notices and obtaining the consents the law requires;
- defraud, scam, phish or deceive callers, including impersonating another business, a government agency or a real person;
- collect information to harass, stalk, threaten, discriminate against or harm anyone;
- run or promote illegal gambling, pyramid schemes, counterfeit goods or other prohibited businesses;
- handle calls for illegal drugs, weapons trafficking, sexual services or content involving minors;
- infringe intellectual-property, privacy or publicity rights.
3. Honest AI and caller safety
You must not:
- configure your agent to claim it is a human, to deny being an AI when asked, or to tell callers the call is not recorded;
- try to suppress, shorten or talk over the AI and recording notice the Service plays at the start of each call;
- ignore a caller's objection to recording or work around how your agent handles it: your agent offers callers who do not want to be recorded another way to reach you from your agent's business information, which you must keep accurate, and you must not pressure them to continue;
- configure your agent to give medical, legal, financial, tax or other professional advice, to diagnose conditions, or to tell callers whether an emergency is serious;
- stop your agent from directing callers who describe an emergency to call 911;
- use the agent to pressure callers into decisions, or to make threats, false urgency claims or misleading statements about prices, availability, licenses or guarantees;
- configure your agent to ask for payment-card numbers, bank account details, Social Security or other government identification numbers, passwords, or similar sensitive identifiers. If a caller volunteers such information anyway, it can appear in the recording and transcript; you must handle it securely and not reuse it;
- receive or store protected health information unless your account has a signed Business Associate Agreement and healthcare mode enabled. Appointment logistics for a business that is not a healthcare provider are not protected health information.
4. Calls and messages
The Service answers inbound calls to your business. You must not:
- use the Service or its numbers to place outbound calls of any kind, including marketing, sales, debt-collection, political or prerecorded calls;
- use the Service to send text messages to callers or to anyone other than the verified recipients of your call notifications. The transactional call notifications the Service sends to you and your team are permitted;
- forward numbers you do not have the right to use, or spoof caller ID;
- make your agent the line for a service whose purpose is responding to emergencies or crises, such as 911 or emergency dispatch, crisis and suicide hotlines, poison control, alarm or medical-alert monitoring, or on-call clinical triage. Ordinary businesses that sometimes receive urgent calls, such as a plumber with burst-pipe calls, may use the Service with urgency rules and should give callers a way to reach a person for real emergencies;
- use the Service to answer calls for another business, or resell it, unless we have agreed in writing;
- generate artificial call traffic, for example to inflate usage or test capacity, beyond reasonable test calls.
5. Content you give your agent
The greetings, instructions, FAQs, documents and knowledge you provide must not:
- be false or misleading to callers;
- contain hateful, harassing, sexually explicit or violent material;
- contain malware, or instructions intended to make the agent ignore its safety rules, reveal other accounts' information or misuse connected tools;
- include another person's personal information that you have no right to use.
6. Security and fair use
You must not:
- access, or try to access, another customer's account or data;
- probe, scan or test the Service's vulnerabilities without our written permission, or interfere with its operation;
- circumvent usage limits, call caps, overage ceilings, rate limits or authentication;
- overload the Service or our providers, or use it in a way that degrades it for others;
- share account access outside your business, or create multiple accounts to obtain extra trials;
- scrape the Service or use automated access except through interfaces we document.
7. Integrations
When you connect third-party software, you must follow that provider's terms and use only accounts you are authorized to connect. You must not use an integration to move data into or out of a system in a way you are not permitted to.
8. Reporting and enforcement
Report suspected misuse to [email protected].
We may investigate suspected violations. Depending on the seriousness, we may warn you, remove content, disable a feature, block specific callers or numbers, suspend the Service, or terminate the account, as described in the Terms. Where the law requires or allows it, we may report illegal activity to the authorities and cooperate with lawful requests. We are not obliged to monitor your use, and not acting on a violation is not a waiver.
9. Changes
We may update this AUP as described in the Terms. Each version is published with its version number and effective date, and earlier versions remain available.
